FAQ

Frequently Asked Questions

General answers to common questions. Every situation is different, so call (843) 640-5315 to talk about yours.

What should I do after a wreck?

Call 911 and ask for a police report. Get checked out by a doctor, even if you feel okay. Take photos of the vehicles, the scene, and your injuries, and get contact information from witnesses. Keep your bills and records. Be careful about giving a recorded statement to the other driver's insurance company before you understand your options. Evidence also fades over time. If you've been hurt, call promptly so you don't miss anything important.

How long do I have to bring a claim?

Deadlines vary depending on the type of claim and who's involved, and some, such as claims involving government entities, can be shorter and come with special notice rules. Evidence also fades over time. If you've been hurt, call promptly so you don't miss anything important.

Does contacting Kennedy Legal create an attorney-client relationship?

No. Calling, using the online intake form, or reading this website does not create an attorney-client relationship. That relationship begins only after a conflict check and a written agreement signed by you and Kennedy Legal. Until then, please don't send confidential information.

What happens on the free 15-minute call?

You tell Preston what happened, and he asks a few questions. He'll explain how matters like yours generally work and tell you honestly whether Kennedy Legal can help. If it's not a fit, he'll try to point you in the right direction.

Preston will explain your options. These may include referring your case to, or co-counseling it with, another law firm. If that happens, you'll be told in advance, and nothing changes unless you agree in writing.

Do you only handle car accidents?

No. Car, truck, and motorcycle crashes come first, but Kennedy Legal is a general practice that also helps with other injury matters, business and contracts, entertainment and creator matters, and more. If Preston can't help, he'll tell you.

How are fees handled?

The first 15-minute call is free. If you decide to work with Kennedy Legal, Preston will explain how fees and costs work, in writing, before you sign anything.

Should I talk to the other driver's insurance company?

Be careful. Adjusters may ask for a recorded statement early on. It's okay to tell them you'd like to talk with an attorney first before you give one.

What if I was partly at fault?

Being partly at fault doesn't automatically end a claim. South Carolina law looks at each person's share of fault, and that can affect a claim. Preston can talk through how it may apply to your situation.

What is a pre-suit claim?

It's the stage before any lawsuit is filed: gathering records, documenting injuries, sending a written demand to the insurance company, and negotiating. Many claims are worked through at this stage. See How It Works on the Home page for the steps.

What happens if my claim needs a lawsuit?
